General Terms and Conditions of FJV Piano Design - FJ Vincent

a) These General Terms and Conditions (hereinafter "GTC") apply to all legal relationships between FJV Piano Design and its customers. They regulate the rights and obligations of FJV Piano Design and its customers.

conclusion of contract

a) All offers in catalogues, price lists or in the online shop represent a non-binding invitation to the customer to buy from FJV Piano Design. With the order, the customer makes a binding offer to conclude a contract. An order confirmation that may be generated automatically does not constitute acceptance of the bid; a contract is only formed when the ordered products are delivered.

b) Accessories that appear on a product image but are not explicitly listed as part of the item are not part of the product offer.

Cancellation and Right of Withdrawal

a) Costs and/or processing fees incurred as a result of the cancellation or change of orders can be passed on to the customer.

b) In the event that FJV Piano Design is unable to deliver, any claims for damages are excluded. Prices, shipping costs and terms of payment

c) The prices published at the time of the order apply. The prices apply subject to any price changes by the suppliers. The customer is not entitled to offset counterclaims.

d) For each delivery, FJV Piano Design charges the customer a share of the shipping costs.

e) When paying on account, the customer undertakes to pay the invoice amount within 30 calendar days of the invoice date without any discount deduction, provided no deviating conditions are noted on the invoice
. In the event of late payment, reminder fees of CHF 20.00 will be charged.

f) First reminder after the first 10 days, second reminder after another 10 days, third and last reminder after another 10 days. If the customer has not contacted us by this deadline regarding the payment date, installment payment, partial payment - the requested amount will be collected via a debt collection agency.
We charge an additional fee of CHF 150.00 for a rightly initiated debt enforcement. Other costs incurred by commissioning a collection agency, material, time investment, etc. and which are unavoidable - will be charged to the customer. Default interest of 5% on the total invoice amount will be charged after the first reminder. (Art. 104 para. 1 OR)

retention of title
a) The products remain the sole property of FJV Piano Design until the purchase price has been paid in full, including any default interest . FJV Piano Design is entitled at any time to have the retention of title entered in the official register at the customer's expense.

Delivery, Acceptance and Inspection

a) For the delivery of the products, FJV Piano Design uses the services of transport companies. Delivery is made to the delivery address specified by the customer. If the delivery is made in partial deliveries, any shipping costs will only be charged once if and to the extent that the partial deliveries were not made for reasons for which the customer is responsible.

b) Orders with delivery addresses outside of Switzerland may incur customs duties and import fees, which the customer must bear. Delivery may be delayed due to customs formalities and long shipping routes.

c) Use and risk of the product are transferred to the customer when the product is handed over to the customer or a recipient designated by him. With mail-order sales, the benefit and risk are transferred to the customer as soon as the product leaves the company or has been handed over to the transport company. If shipping is delayed for reasons for which the customer is responsible, the risk passes to the customer at the time originally scheduled for shipping or handover.

d) The customer or his representative must check the product for accuracy, completeness and integrity immediately upon receipt
. Any defects must be reported to FJV Piano Design within 10 calendar days of receipt of the product. The product must be kept in the condition in which it was delivered, including the transport packaging, for further claims processing and may not be used or put into operation.

e) If products are delivered with identifiable transport and packaging damage, the customer must complain immediately to the carrier and refuse acceptance. Hidden defects must be reported to the carrier within 24 hours of receipt of the products. The customer is obliged to obtain a damage confirmation from the carrier. Any transport damage must be reported immediately.

guarantee

a) FJV Piano Design has no influence whatsoever on the functionality of the products or the warranty provided by the manufacturer. The manufacturer's guarantee conditions always apply. The manufacturer's warranty does not limit the statutory warranty obligation.

b) In the event of a warranty claim, the manufacturers provide for repair or replacement with a product of the same or equivalent value. In any case, the decision lies with the manufacturer. The customer has no right to cancellation or reduction. In the case of special price offers, there is no entitlement to an equivalent replacement.

c) The provision of warranty services does not extend or renew the warranty period for the product.

d) If the manufacturer charges costs, these will be borne by the customer. In the case of products that do not have any detectable defects or the defect is not covered by the manufacturer's guarantee, the manufacturer can pass on the costs for the inspection and shipping to the customer.

e) Shipping and/or transport costs incurred in connection with the warranty or guarantee are
to be borne by the customer, unless otherwise specified in the respective guarantee conditions.

f) Defects caused by natural hazards, moisture damage, fall and impact damage, overload, wear and tear, aging, lack of maintenance or care and improper handling are excluded from the warranty or guarantee. The warranty or guarantee expires if goods are further processed or modified by the customer despite recognizable defects. Wearing parts are excluded from the warranty or guarantee.

returns and withdrawals

a) A return is only possible in the case of wrong deliveries or manufacturing defects within 10 calendar days after delivery and after prior consultation. In the event of a return, the invoice or delivery note must be enclosed.

b) Products that have been specially made for the customer cannot be returned at all. The same applies to all products that have been offered at a special price.

c) All returns will only be accepted if the product is returned unopened and in its original packaging. The customer bears the costs for the return or the return transport of the goods.

d) FJV Piano Design offers each customer - after appropriate registration - password-protected access to the online shop. FJV Piano Design reserves the right to delete customer data at any time or to block a user account and password.

e) The customer data in the "user account" and the personal access data are treated confidentially. Any obligations to surrender based on official orders remain reserved.

data protection

a) All personal data will be treated in accordance with the provisions of the Swiss Data Protection Act and protected against unauthorized processing by appropriate technical and organizational measures.

b) The customer is aware and expressly agrees that his personal data required for order processing and archiving will be stored on data carriers. The customer agrees to receive offers or information from FJV Piano Design on a case-by-case basis. FJV Piano Design is entitled to use the data for the purpose of credit checks and creditworthiness monitoring, to the extent necessary for business transactions.

c) The customer can revoke his consent in writing at any time with effect for the future. FJV Piano Design undertakes to delete personal data in the event of revocation.

Disclaimer

a) All information about products, services, warranty conditions and warranty periods are subject to change. In particular, no liability can be assumed for the correctness, completeness and topicality of the information.

b) Subject to the customer's claims expressly mentioned in these GTC, all customer claims (in particular claims for damages, claims due to delays in delivery, retention of the purchase price, compensation for lost profits, reduction in price, cancellation of the contract or withdrawal from the contract), regardless of the legal reason and to the extent permitted by law, are excluded. Any liability for consequential damage resulting from the use of the products is rejected.

In particular, FJV Piano Design assumes no liability whatsoever for direct or indirect damage or consequential damage incurred by the users of the websites.
